It has been evident in the past few weeks that there is an underlying darkness to the glamour and fame and the limelight of Hollywood. Recently, a number of women who have worked alongside high profile Hollywood moguls such as Harvey Weinstein allege that sexual advances or assaults were carried out on them in order to advance their careers.
This is from experience typical authoritative figure abuse that is most prevalent in abuse cases involving teachers or sporting coaches. It now appears that it goes one step further and some have been allegedly using their professional status to manipulate individuals into carrying out sordid sexual acts.
Some of those who allege they were sexually assaulted by Weinstein have instigated civil claims for damages. Dominique Huett launched a $5million (£3.8 million) civil suit in Los Angeles superior court claiming The Weinstein Company enabled its Oscar-winning founder’s “repeated acts of sexual misconduct.”
Zelda Perkins along with a colleague has previously settled a claim against Weinstein amounting to a sum of £250,000, to be divided equally and a legally binding contract.
Those who were allegedly assaulted by Weinstein or any other high profile figure may have a viable claim for damages for the assaults themselves and the subsequent harm caused. This can also include damages for loss of chance, loss of earnings and any therapy that may be necessary.
These claims are by no mean straightforward, they are restricted by limitation laws in governing countries/states and of course the assaults need to be proven.
If the assaults occurred in the UK but the perpetrator does not reside in the UK, this does not preclude an individual from bringing a claim for damages. The High court can consider cases out of jurisdiction and Verisona Law have successfully brought a claim under those exact circumstances, with settlement in favour of the Claimant for over £130,000.00
In some circumstances the employer may be responsible for the assaults if it can be proven that there was a close connection between the circumstances and the assaults carried out.
